| Mental Capacity Bill |
Introduction:
This Act introduced a legal framework giving a nominated individual
power of attorney over a patient’s affairs. It includes
the notion of ‘advanced directives’, which allows
a capable person to make an “advance decision” to
refuse treatment or even nutrition if they later become incapable.
Many Peers and MPs have expressed dismay that this constitutes
Euthanasia. Despite a clause being inserted - Clause 58, which
states that this Bill does not affect the current law on homicide
- there remains serious cause for concern.
